Devout – Terms and Conditions

Introduction
Welcome to Devout, a Christian community platform designed to help believers connect in meaningful ways. These Terms and Conditions ("Terms") are a binding agreement between you and Devout LLC ("Devout," "we," "us," or "our"). By creating an account or using our Services (the Devout mobile application, website, and related services), you agree to be bound by these Terms. If you do not agree, do not use Devout.
1. Eligibility
You must be at least 18 years old to use Devout. By using the Services, you represent that: • The information you provide is accurate and truthful. • You have not previously been removed or banned from Devout. • Your use complies with all applicable laws.
2. Account Responsibilities
You are responsible for all activity under your account. • Keep your login credentials secure. • Notify us immediately of any unauthorized use.
3. Acceptable Use
By using Devout, you agree to: Use the Services for personal, non-commercial purposes only; and treat others with respect and dignity, consistent with Christian values. You agree not to: • Harass, exploit, or harm others. • Post content that is offensive, obscene, unlawful, or misleading. • Impersonate another person or misrepresent your identity. • Use bots, scrapers, or other unauthorized tools to access or collect data.
4. Content and Data Rights
User Content You retain ownership of the content you create, post, or upload ("User Content"). By posting User Content, you grant Devout a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, distribute, modify, display, and perform such content in connection with operating, improving, and promoting the Services. This license remains in effect while you use Devout and for a reasonable period afterward for archival and operational purposes. Data Rights You acknowledge that Devout collects and uses information about your activity and interactions with the Services. Devout may use aggregated or anonymized data for analytics, research, product development, and other lawful business purposes. You will not receive compensation for our use of User Content or data.
5. Safety and Interactions
Devout does not conduct background checks on users. You are solely responsible for your interactions, online and offline; exercise caution and discernment. Devout does not guarantee the behavior, intentions, or compatibility of users.
6. Subscriptions and Payments
Certain features may require a paid subscription. Fees are stated in USD and are non-refundable, except where required by law. Subscriptions renew automatically unless cancelled before the renewal date. We will clearly disclose renewal terms, frequency, pricing, and how to cancel before purchase, consistent with applicable consumer protection laws (including NY/CA auto-renewal requirements).
7. Termination
Devout may suspend or terminate your account at any time for violations of these Terms or conduct inconsistent with our community values. You may delete your account at any time through the App settings.
8. Disclaimers
The Services are provided on an "as is" and "as available" basis. We make no guarantees regarding matches, outcomes, or uninterrupted access. Devout disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
9. Limitation of Liability
To the maximum extent permitted by law: Devout Resources LLC, its affiliates, officers, employees, agents, and partners shall not be liable for any damages of any kind, including direct, indirect, incidental, consequential, special, exemplary, or punitive damages, arising out of or relating to your use of the Services, user interactions, or reliance on content. In no event shall Devout’s total liability to you for any and all claims exceed zero dollars ($0.00), regardless of the cause of action. Some jurisdictions do not allow certain liability exclusions (e.g., for gross negligence or intentional misconduct). In those jurisdictions, our liability is limited to the fullest extent permitted by law.
10. Governing Law, Arbitration & Class Action Waiver
Governing Law These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles. Binding Arbitration Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in New York, NY, unless we both agree otherwise. You and Devout waive any right to a jury trial. Class Action Waiver To the fullest extent permitted by law, disputes must be brought on an individual basis and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding.
11. Privacy
Your use of Devout is also governed by our Privacy Policy, which describes how we collect, use, and share your information.
12. Changes to Terms
We may update these Terms at any time. If we make material changes, we will provide notice (e.g., in-app notice or email). Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
